Driver Obligations

Is a KahDo contract right for you? If your application is successful and you proceed to sign a driver contract with KahDo, you will be expected to bear certain obligations and responsibilities in consideration for receiving a subsidised lease of a KahDo car.

A summary of the obligations follow – read them to help you decide whether or not to move to the next stage, being the application process. Please note that the following points are only a summary of some of the possible obligations you may have to give you an indication of whether the KahDo system is suitable for you. No contract will exist between you and KahDo until your application has been formally accepted and you have signed all of the relevant documentation.

1. The KahDo concept

1.1 The KahDo concept allows KahDo drivers to enjoy a subsidised lease of a KahDo car for a contracted term, usually 12 months, in return for allowing KahDo to affix advertising to the vehicle and track the circulation of such advertising through a GPS system.

1.2 All advertising placed on the vehicle will be in accordance with Australian Outdoor Advertising Regulations and standards. Therefore, KahDo drivers must make the car available for advertising to be affixed to the vehicle and must accept all advertising provided from time to time without question.

1.3 The primary role of a KahDo driver is to make sure that the advertising is seen by as many people as possible. For this reason, we require that KahDo drivers:

(a)  drive a minimum of 500km per month in a designated area (on the understanding that KahDo drivers will be charged for any mileage in excess of 15,000km in any year at the rate of $0.15cents per km);

(b)  park the vehicle in the street (or public parking stations) as opposed to in a lock up garage;

(c)  make the vehicle available for and give KahDo unrestricted access to the outside of the vehicle to allow KahDo to replace the advertising on the outside of the vehicle from time to time;

(d)  accept that each KahDo car comes with GPS tracking equipment and that such tracking equipment will be used to monitor the driving patterns of the vehicle for the purpose of collecting data and reporting on the circulation of advertising affixed to it;

(e)  accept that any information collected in relation to the Driver and the vehicle is owned by KahDo and is intended for KahDo’s use;

(f)  use their best endeavours to participate in Advertiser and KahDo events, accept information from Advertisers and Advertiser product samples;

(g)  be responsible for the costs of operating (for example, petrol and cleaning) and insuring the vehicle but excluding registration and maintenance costs (which amount is factored into the weekly cost of the vehicle).

2. What sort of Subsidy will KahDo Drivers Enjoy?

2.1 In return for complying with KahDo’s conditions, KahDo will subsidise the overall costs of the lease of the vehicle, meaning that a KahDo driver need only pay leasing costs of $42.00 per week. The costs of registering and maintaining (for example, servicing) a KahDo car are factored into this weekly amount.

2.2 KahDo drivers will, however, need to cover other costs, for example operating costs such as petrol and cleaning and comprehensive insurance. KahDo will provide Drivers with compulsory comprehensive car insurance, however additional costs will apply and costs of insurance may vary depending on the age and driving history of the driver.

2.3 We also require our drivers to provide us with a bond of $500 to cover any costs we incur in making good damage to the car or making good a driver’s obligations under the driver contracts should they not satisfy them. Naturally, this bond will be fully refundable on termination should we not need to make use of it.

3. Driver Responsibilities

3.1 A KahDo driver must be at least 23 years of age and must have held a driver’s license for at least three years. A KahDo driver will also not have been involved in a motor vehicle accident caused by them in the 12 months immediately prior to entering into a KahDo contract.

3.2 As you would expect, there are other expectations we have of our KahDo drivers. For example, KahDo drivers:

(a)  are responsible for their vehicle from the date it is handed to the driver;

(b)  are required to care for the vehicle strictly according to the recommendations and vehicle manual provided by the manufacturer and ensure that all vehicle equipment that may need replacing from time to time (for example tyres and windshields) is brought to KahDo’s attention immediately;

(c)  are required to keep the vehicle clean and tidy, including the outside of the vehicle, so that the vehicle wrapping is clearly visible;

(d)  must not to tamper with, modify, damage or make additions to the car, any of the equipment within the car or with the advertising on the outside of the car;

(e)  must ensure that any damage to the vehicle, the equipment in the vehicle or the advertising material on the outside of the car is reported to KahDo immediately;

(f)  must allow KahDo access to the inside of the vehicle to restore, maintain or replace any equipment (including the GPS) in the vehicle;

(g)  are to make themselves available for appointments (noting that seven (7) days notice of such appointment will be given to the driver by KahDo) at venues nominated by KahDo from time to time to allow KahDo to install or remove advertising material;

(h)  are to make the car available for servicing and repair as directed by KahDo from time to time;

(i)  must advise KahDo if the car will not be driven for a period exceeding eight (8) days;

(j)  are to ensure that they act responsibly, lawfully and at all times ensure that they do not do anything to injure the good reputation of KahDo or it’s Advertisers.

4. Termination of the Contract Before the End of the Term

4.1 KahDo drivers are selected because of representations that they make to KahDo during the selection process – for example, their driving patterns. If there is a significant change to these driving patterns ( for example, a change of residential or employment address) during the term of the contract, KahDo drivers must inform KahDo about these changes. KahDo will review the changed driving patterns and determine whether or not the contract should continue.

4.2 Of course, if you do not satisfy any of the conditions of the contract and the driver obligations, KahDo may be forced to terminate the contract. In some circumstances (such as if you are found guilty of a criminal offense or if you lose your drivers license), KahDo may terminate the contract immediately. You may need to pay KahDo damages for loss of advertising revenue if you fail to satisfy the obligations in the contract, capped at $624 per month.

4.3 If the contract is terminated early by you, then you may be required to pay a $100 early termination administration fee.

5. What Happens on Termination?

  On termination of the contract, the driver must return the vehicle to KahDo in first class condition (reasonable fair wear and tear excepted), registered, in full operating order with all manuals, associated documentation and compulsory insurance intact. Drivers will be required to pay any costs required to return the vehicle to this condition.
